Well, it's the ASA's job really. I reckon existing laws could deal with it if they just showed some backbone and ruled against it - putting the cap in the T&C is a pretty pathetic loophole, it's quite obvious what these companies are doing and the ASA has the power to intervene in such situations as I understand it. I don't understand why this has been going on for so long now.
I totally agree that the ASA has been turning a blind eye. No ISP can realistically offer unlimited usage, it's like banks offering unlimited credit (and I doubt any ISP has the infrastructure to allow all their users 100% utilisation at their full ADSL speed 24/7).
