So, the bad news is, I got a letter from the Thames Valley Police this morning, informing me that they're not going to take any action regarding my accident, i.e. they won't be prosecuting him for driving without due care and attention. Which is a shit.

But the good news is, I got a letter from my solicitor this morning, with a cheque for £3100 as an interim payment against the value of my motorcycle. I don't think this counts as the other guy admitting anything, it's more of an interest-free loan I suppose, but it's going to make paying my bills a hell of a lot easier for the next couple of months.

It doesn't say, no. My solicitor will be obtaining a copy of the police report now that they've finished with the matter, so presumably that will say. It's probably something to do with the witness (friend of the driver) who claims I was speeding - the CPS are very reluctant to pursue anything where they're not 100% sure of victory.

Well, in a case of one person's word against another's with the only witness being pretty much unreliable through conflict of interest, I can sort of see where they'd be coming from. Still sucks, but it makes sense... :/

Can you take a civil case against the driver for loss of earnings etc etc and pain and whatnot? I know next to nothing about law but thought that even if the CPS wouldn't take up a case that you could either appeal against that or take your own case against them.

Yes, they're two entirely separate matters (although it would have made my civil claim considerably easier if he had been prosecuted for driving without due care and attention). At present my lawyer is dealing with his insurance company - if his insurance company don't come up with a satisfactory compensation offer, then I'll see him in court eventually.

Yes, the burden of proof for criminal cases is "beyond reasonable doubt", with civil cases it's a 50% rule.
